I. Introduction

Talign Inc. (“Talign,” “Company,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard your information when you use our Services, which includes our Sites, Service Platform, and any other services that link to this Policy. By using our Services, you agree to the terms of this Policy. Please read this Policy carefully to understand our practices regarding your information.

This Policy may be updated from time to time (see “Updates to Our Privacy Policy”). Your continued use of our Services, and continued interaction with us after we make updates to our Policy is deemed to be acceptance of those updates. Talign applies this Privacy Policy worldwide. 


II. Scope of this Privacy Policy

This Privacy Policy applies to the customer data processed through our Service Platform by or on behalf of Customers. In the majority of cases, Talign acts solely as a Data Processor or Service Provider, processing data under the instructions of our Customers, who are the Data Controllers.

Customers are responsible for ensuring that they have provided all necessary notices and obtained all necessary rights, consents, or legal bases for the collection and processing of employee and workforce data through our Services.

Talign may act as a Data Controller only in limited situations (e.g., when processing data from users of our marketing website or support services).


III. Terms Used in this Privacy Policy

These definitions are intended to provide clarification and help you better understand this Policy:

“Customer” means the organization that has entered into an agreement with Talign to use our Services.

“Our Services” means the Sites, the Service Platform, the App and any other interaction you may have with us (for example: email and support interactions, events or other offline interactions).

“Sites” means the Talign website (www.talign.io) and other web pages we operate in which we post a direct link to this Policy.

“Service Platform” means the Talign software and app.

“Customer Data” means the data we process in the Service Platform as governed by a Subscription Agreement.

“Subscription Agreement” means a separate agreement governing access to and use of the Service Platform by Customer and its authorized users.

“Personal Information” refers to any information relating to an identified or identifiable individual.

“Data Controller” is the entity that determines the purposes and means of the processing of personal data.

“Data Processor” is the entity that processes data on behalf of the Data Controller.

“Aggregated Data” is data that has been de-identified and combined with other data to prevent identification of specific individuals.


IV. Information We Collect

We collect information when you visit and use our Sites, Service Platform, or otherwise interact with us. We may collect information in the following ways:

a. Information You Provide Directly

Account Registration: We may collect customer information including – name, email address, company name, job title, phone number, and other contact details.

Account Credentials: Usernames, passwords, and other security information used for authentication and account access.

Billing and Payment Information: We may collect billing information when you subscribe to our Services, register for our events, or training.

Support Communications: You may provide information to us through our customer support services. When you open a support ticket, speak to one of our team members, or engage with our support team, you will be asked to provide contact information, a summary of the problem, and relevant documentation, screenshots or information for purposes of resolving the issue.

User Input: Information submitted or entered by users into our Service Platform, including responses to prompts, survey entries, form fields, and other user-generated content as part of using our Services.

Recruitment Information:
You may provide us with information in connection with a job application or inquiry.

Registration Information: We collect your information such as name, email address and phone number when you register for our events, forums, or webinars.

Additional Information Provided to Talign: We receive other information when you submit content to our Sites (e.g. contact us), when you download our newsletters, when you indicate that you would like to receive any of our Services, when you visit our offices, when you speak to us over the phone, when you participate in surveys or focus groups, when you provide a testimonial, and when you interact with our branded social media accounts.

Demographic Data: We may collect demographic information when you use our Service Platform if you voluntarily provide this information.

Sensitive Information: We may collect food allergies or dietary requirements information which can imply or suggest your religion, health, or mobility requirements. Such sensitive data is only shared within Talign or with our third-party service providers acting as Data Processors for the purpose of providing the services you request and will not be shared or used for any other purposes.

Other Sensitive Information: We do not collect information that is particularly sensitive (e.g. genetic data, biometric data). 


b. Information We Collect Automatically

We use tools such as cookies, web beacons and similar technologies to automatically collect information from your computer or mobile device as you navigate through or use our Services.

Usage Data: We collect information in connection with the use of our Service Platform by individual users. This includes Internet Protocol (IP) address, browser type, session ID, the features you use, the links you click on, login date and time stamps, content viewed or created, the requests you make, data related to your user input such as types of prompts, frequency of use and interaction time stamps, and other actions you take.

Device Information: We collect data from the device you use to access our Services such as IP address and browser type. When you download and use our Services, we automatically collect information on the type of device you use, operating system version, and the unique device identifiers (“UDID”).

Location Identifier: We collect the geolocation information when you use our Services, if you have enabled location services on your device.

Log Data: Our servers collect information when you access or use our Sites and record it in log files. This information includes IP address, the address of the web page visited, browser type and settings, operating system, login date and time stamp, information about browser configuration and plugins, language preferences, and cookie information. 

Cookies and Similar Technologies Information: Cookies are small text files that are stored on your computer by your browser when you visit a website. We, or an authorized third party, may use cookies, web beacons, and other technologies to collect information about your interactions with our Services. You can control the use of cookies at the individual browser level but choosing to disable cookies, which may limit your use of certain features or functions on our Sites.

Mobile Analytics: We use mobile analytics software to allow us to better understand the functionality of our Apps. This software may record information such as how often you use the application, the events that occur within the application, usage, performance data, and where the application was downloaded from.

Social Media Features and Widgets: Our Sites include social media features or widgets. Use of these features may collect your IP address, the page you are visiting on our Sites, and may set a cookie to enable features to function properly. Your interactions with these features are governed by the privacy notice of the third party providing these features.

Login Data: For our Service Platforms, we provide you options to login using a third party account such as Google or Microsoft. If you choose to login this way, we collect the information described in the section Third Party Login Process below.

Marketing Information: If you choose to receive marketing emails or newsletters, we track whether you have opened these messages and whether you clicked on the links contained within these messages to better personalize future communications.

c. Information We Collect from Other Sources

We collect information about you from other sources, including:

Third Parties: From whom we have purchased contact information.

Business Partners: Data we receive from partners who refer you to us or integrate with our Services.

Social Media: Information you publicly share on social media platforms or that you authorize us to access.

We may combine all this information and/or use this information to update and analyze our records, identify new customers and create tailored marketing communications. 

V. How We Use the Information We Collect

Information that Talign collects and receives is used for legitimate business interests or to comply with legal obligations. This includes to:

Provide, Operate, Maintain, and Improve Our Services: Deliver our Services under a Subscription Agreement; prevent or address service errors; monitor security or technical issues; analyze and monitor usage or trends; track aggregate traffic patterns throughout our Sites; measure and analyze user behavior; other activities upon a customer’s request; and to operate, maintain and improve our Services.

Communicate with You About Our Services: This includes providing customer support; responding to your comments, questions, and requests; informing you about changes in our Services; sending important Services-related notices such as downtime or security alerts; announcements regarding new product features; and responding to your requests and questions. These are service-related communications and you may not opt out of them.

Send Relevant Administrative, Marketing or Promotional Material: We use contact information to send you marketing and promotional communications or other Talign news that may be of interest to you. We combine information from third party sources with information we hold about you to help make our sales and marketing efforts more relevant to you, and to personalize and improve your experience. These are marketing messages and you can control whether you receive them.

Manage Events and Attendance: We use information to manage our events, track attendance, and obtain feedback to improve future events.

Engage Through Forums and Surveys: We use contact details, comments and feedback to engage with our customers and partners in online forums and for conducting customer satisfaction, industry research, and post-training surveys. We use survey results to help improve products and services.

Enhance Services: Personalize your experience with our Services. We improve and enhance our Services based on customer feedback, historical use and interaction with AI tech systems such as predictive modelling and machine learning.

Train and Educate: We use contact details for the purpose of providing training and education for our customers and partners.

Testimonials: We display customer or user testimonials in our marketing materials with consent. If you wish to update or delete your testimonial, please contact us by email to marketing@talign.io.

Third Party Login Process: For selected platforms we offer you the ability to login using your third party account details (such as Google or Microsoft). If you choose to link your account with us to a third party account, we use the information you allow us to collect from those third parties to facilitate the login process. This may include name and email address, and other information you choose to make public. We do not control, and are not responsible for, other uses of your personal information by your third party provider. We encourage you to review their privacy notices to understand their privacy and information practices.

Security Incidents: Detect, prevent, and address security incidents and other illegal activities.

Legal Obligations: Comply with legal obligations and enforce our agreements.

Manage Accounts: Process transactions and send transaction-related communications. We use your information to contact you for invoicing, account management and to keep track of billing and payments.

Aggregate Data: We may de-identify and aggregate your information with other information we collect for purposes of performing statistical and other data analysis. Even when we may have a legitimate interest in processing your information, we will not do so if it overrides your interests, rights and freedoms.

VI. How We Share and Disclose Information

We do not sell, share or otherwise disclose information we collect except as described in this Privacy Policy. We share information in the following ways:

Within Talign: We share information within the Talign group of companies for purposes of data processing and storage.

Third Party Service Providers: We share information with third party service providers who have been appointed as Data Processors to perform functions and services on our behalf and who are provided only with information necessary to perform the services. Examples of these services include customer relationship management, payment processing, hosting, and content creation. Service providers are not permitted to disclose information to others without our authorization or to use information for their own purposes.

Partner Products or Services: We partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share information we collect from you in connection with your purchase with our joint promotion partners. If you do not want us to share your information with these companies, please contact us at privacy@talign.io. We do not control our business partners’ use of your information which will be in accordance with their own privacy policies.

Legal Requirement: We may be compelled to disclose information in response to a lawful request to meet national security or law enforcement requirements, as well as to protect the rights, property or safety of Talign, its business partners, you or others. This includes complying with court orders such as subpoenas, warrants, or other legal processes.

Merger, Acquisition or Sale: We reserve the right to transfer information in the event we are involved in a merger, acquisition, sale of any or all assets, or financing. You will be notified by email or prominent notice on our website of change in ownership, uses of your information and choices you have regarding your information.

With Your Consent: Where you have specifically authorized us to share information.

VII. Talign Forums

You may post comments or questions on our websites or engage with Talign facilitated events or discussions; for example, on a community forum, comments section, discussion forum, live or in-person sessions, or workshops. Some of these forums allow you to provide your personal information and create a profile. Personal information you submit, post, or discuss in forums can be read, collected and used by others who access those forums.

VIII. International Data Transfers

Talign operates globally and may transfer personal information to countries outside of the originating jurisdiction, including to any Talign subsidiary, or to third parties and business partners that are located in countries around the world, and countries outside the European Economic Area (EEA).

When you provide personal information to Talign, you consent to the processing and transfer of your information outside of your country of residence where data protection standards may be different. We comply with applicable data protection laws when transferring personal information and implement appropriate safeguards with respect to the protection of your privacy. Personal information transferred outside the EEA to countries that the EC and the UK has not found to provide adequate protection will be protected by EC-approved Standard Contractual Clauses (SCCs) or other appropriate data transfer mechanisms, as required by law. 

IX. Data Security

In order to protect your information from unauthorized loss, or unauthorized use, access or disclosure, Talign employs reasonable and appropriate physical, technical and security safeguards to protect information. This includes the adoption of industry standard technical and organizational measures to secure the information we store. Access to your information is restricted to authorized Talign employees and authorized third parties who need to know that information in order to process it for us and who are subject to strict confidentiality obligations.

Our Services employ Secure Socket Layer (SSL) technology using both server authentication and data encryption (in transit and at rest). Our Services are hosted in a secure server environment that uses firewalls, intrusion detection systems, access controls, authentication protocols, and other advanced technology to protect against interference or access from outside intruders.

While Talign has implemented safeguards to protect your information, given the nature of communications and information processing technology, Talign cannot guarantee that your information is absolutely secure in all situations. It is your responsibility to ensure you are accessing our Services using an up-to-date web browser. You are also responsible for maintaining the security and confidentiality of any usernames and passwords associated with our Services.

For your own protection, we encourage you to not include personal information, credit card, or other sensitive information in any emails you send to us.

Keeping your information secure is our priority. We encourage responsible reporting of any vulnerability that may be found across our Services. X. Data Retention

Talign retains information (including information we process on behalf of our Customers) for as long as needed to fulfill the purpose for which it is collected or as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. Talign retains Customer Data according to the timeframes set forth in the Subscription Agreement or as otherwise authorized by our customers.

XI. Information We Process on Behalf of Third Parties

Customers routinely provide Customer Data for processing in connection with our Service Platform. Talign does not share or distribute any Customer Data except as described in the contractual agreement between Talign and the customer, or as may be required by law. We process Customer Data in our Service Platform under the direction of our customers. Talign has no direct relationship with the individuals whose personal information is contained in the Customer Data. Our customer is the “Data Controller” with respect to its Customer Data and Talign is the “Data Processor”. The customer is responsible for providing all notices and fulfilling all requests associated with the collection and use of Customer Data.

If you believe that your information has been provided to Talign by one of our customers and you would no longer like to be contacted by that customer please contact the customer directly. As part of the services we provide to our customers, we may transfer their Customer Data (which may contain your information) to companies that help us provide our services. Transfers of this data to such third parties and any subsequent third parties are covered by the service agreements we maintain with our customers.

If you seek to access, correct, amend, or delete inaccurate information that is contained in Customer Data, you should direct your query to the Talign customer that provided Talign with the Customer Data (the Data Controller). 

XII. Your Rights and Choices

Depending on your jurisdiction, you may have rights relating to your information under privacy or data protection laws. Subject to verification of your identity, you may request access to and correction of, your information.

Additionally, the following options are available to you, upon request, for the exercise of your rights:

–Provide a description of the information we process about you;

–Rectify or update inaccurate or incomplete information about you;

–Delete or request erasure of information about you (unless an exception applies);

–Restrict the processing of information, in certain circumstances;

–Withdraw your consent where you have previously given consent to process your information; and

–Provide a copy of your information in a structured, commonly used and machine- readable format, in certain circumstances.

These options may be limited in some situations such as where we can demonstrate that we have a legal requirement or legitimate interest to process your information.

If you subscribe to our newsletter(s) or other marketing communications, you may choose to stop receiving those communications by using the unsubscribe link included in our emails or by contacting us by email to marketing@talign.io.

XIII. Children’s Privacy

In accordance with the U.S. Federal Children’s Online Privacy Protection Act (COPPA) and other applicable data protection laws, Talign does not knowingly collect personal information from any individual under the applicable age of consent without parental or guardian consent. If you believe that we may have collected personal information from someone under the applicable age of consent in your country without the proper consent, please contact us by email to privacy@talign.io and we will take action to investigate and delete such information. 

XIV. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to improve user experience and for analytics and marketing purposes. You can control cookie settings through your browser settings.

XV. Links to Third-Party Sites

There may be links to third-party websites and services that are outside our control and which are not covered by this Privacy Policy. We are not responsible for the privacy practices or the content of such third parties.The information practices and the content of such other websites are governed by the privacy policy of such other websites. We encourage you to review the privacy policy posted on those websites to understand their information practices. 

XVI. Additional Notices (where applicable)

Notice to EEA and UK Residents: You have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

Notice to California Residents: If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. You can find more information about your rights under the California Consumer Privacy Act (CCPA).

Notice to End Users: Where the Services are made available to you through an organization (e.g. your employer), that organization is the administrator of the Services and is responsible for the accounts and/or Services over which it has control. Talign is not responsible for the privacy or security practices of an administrator’s organization.

XVII. Updates to This Privacy Policy

This Privacy Policy is updated from time to time to reflect changes in our Services, practices or technologies, and to comply with legal requirements. When we make updates, the most current version will be posted on our website. We encourage you to review this Privacy Policy to stay informed about our privacy practices.
